What exactly does a purchasing process look like in Spain?

The search process can be divided into 3 concrete choices:

  1. You choose an area you are interested in.
  2. You work with a broker who suits your needs, is well known in the region of your interest and with whom you have a good feeling.
  3. You choose the right home that suits you.

Once the right home has been found, the real estate agent's and lawyer's work really begins.

  1. The estate agent provides a reservation contract for the property, with which it is taken off the market with a down payment of €3,000 to €5,000.
  2. At the same time, the real estate agent requests all documents (Nota Simple, Cedula de Habitabilidad) of the property, which contain the registration, cadastral data, buyer and seller data and the agreements made regarding the purchase.
  3. The lawyer will check the documents received with the relevant authorities, so that any problems are known in advance. If a property is not properly registered or in possession of the correct documentation, the reservation amount is subject to refund.
  4. At the same time, the process of applying for a Spanish identification number (NIE number) and opening a Spanish bank account for the buyers starts.
  5. After complete checking by the lawyer and his approval, the exact transfer date will be determined in consultation between buyer and seller. The lawyer is physically described in the title deed, as responsible for the checks carried out.
  6. The buyer and seller both come to Spain (or are represented by notarial powers of attorney) to complete the transfer. In Spain this is still a real transfer moment, where the keys and the final payment are exchanged. The lawyer takes care of the transfer of water, electricity, registration in the municipality, etc.)
